    Legal Separation in Georgia


    Under Georgia law, there is no set amount of time you need to be separated before you can file for divorce. You only need to be separated on the date of filing. In addition, a couple can be separated and still live under the same roof. If you choose to live under the same roof however, and you are physically intimate with your spouse, you are not considered to be living in a “bona fide” state of separation.

    The steps that need to be taken in a legal separation are largely the same as those needed for a legal divorce, so you can expect the cost for a separation and a divorce to be the same. Issues like child support, alimony, custody, property division and others will all need to be addressed as they would in a divorce.
